Case# C1-04-OC-000777
Judge: James Stroker
Dear sir on July 28th I came before you to have you set a date for trial by jury on case C1-04-OC-000777 and you took it upon yourself to dismiss the case. When you ran for office you signed a loyalty oath to uphold the constitution of the United States of America. On the 28th of July you failed to do this and put yourself above a citizen’s right to a fair trial by jury. I have been told that you are the constitution of the United States of America and I will agree with you, the judicial power shall extend to all cases, in law and equity, citizens or subjects arising under the constitution. Section II: clause I, of the constitution.
The power not delegated to the United States by the constitution, nor prohibited to it by the states, are reserved to the states respectively, or to the people, the X amendment. The constitution of the United States was setup for the governing of the people and those within the government would always be held accountable to we the people. The supreme law of America is one vote if it is counted. As a citizen of the United States of America I have authority over you and the constitution controlling you by my vote. The vote of the American people is the most powerful weapon in the world today because it put in places the people that control the world we live in, If it is counted. The voting systems that are in place in the state of Florida and our nation are a joke and can be tampered with at will. Our voting system should be simple and accountable with the check and balance that our constitution was setup on and should be the same in each state and county. The second reason to go to war with England was the lack of trial by jury. Article III: of the constitution clause 3: All crimes shall be by jury. Under the constitution you do not have the right to put yourself in place of a jury. Therefore a jury trial is still demanded.
I answered all of the letters of dismissal I got except those from Glenda Hood and Tom Gallagher, and I know that you read them from what you said, to help explain to the jury the reason I filed on each of the defendants. It is up to the jury to decide if they are guilty or not. With Glenda Hood and Tom Gallagher the counsel dropped the ball and a judgment should be entered based on your laws. The same judgment should be entered against Governor Bush and Lt. Governor Toni Jennings because they work for them. In my complaint I did not ask the court to make a law, I am asking a jury to force the law-making branch of our government to put in place a fair and accountable voting system as good or better than Bob’s Way Ballot.
U.S. Supreme Court
Highlighted Points On Our Right to Vote
Reynolds V. Sims, 377 U.S. 533 [1964] Under the equal protection clause that the rights allegedly impaired are individual and personal in nature
United States V. Bath Gate, 246 U.S. 220-227 The right to vote is personal
S. Kinner V. Oklahoma 316 U.S. 535 Such a case touches a sensitive and important area of human rights, and involves one of the basic civil rights of man in violation of the constitution guaranty of just and equal laws
316 U.S., AT 536,541 Any alleged infringement on the rights of citizens to vote must be carefully and meticulously scrutinized.
Yick Wo V. Hopkins The court referred to the political franchise of voting as a fundamental political right, because preservative of all rights 118 U.S., AT 370
The counsel didn’t use the Florida Statutes against me because the counsel knows that they violate my rights. The voting systems in place in the state of Florida violate the Florida and the United States Constitution by depriving me of my voting rights by not having my vote properly counted.
See the following section:
101.015 [Standards for voting systems]
101.5605 [Examination and approval of systems]
101.5606 [Examination and approval of systems]
101.572 [Public inspections of ballots]
102.166 [Manual recounts]
104.051 [Violations; Neglect of Duty; Corrupt Practices]
Etc, etc. The governor and his capitals are in violation of these statutes.
Notice of Hearing
Your secretary gave me the date of the hearing and you were there so you knew about it and so did the counsel. I sent each defendant a latter with the date on it. I sent only one certified mail to Charlie Crist the Attorney General. It is a shame that the leader in our government would lie about this.
Imposed Sanctions
In 1989 the board of county commission of Osceola County imposed sanctions on me for their own personal gain. They used the system that is called our government to destroy my business, my home and my family. They used all local and state agents to do one of the greatest jobs in the world in destroying a man and his family. The board of county commission laughs so hard in a board meeting about signs they had put up on county roads they liked to have feel out of their chairs. So am I scared of your sanctions? [yes] but a jury trial is still demanded. If a jury trial for Case# C1-04-OC-000777 is not set within [10] Ten days from the recorded date of this letter I will file a class action suit, because I am not alone anymore, to have you and the clerk of the court remove from office for not obeying your oath of office. We will file an injunction against the state to stop the general election until we have a fair and accountable voting system put into place.
Was I a state candidate? Case# FEC 02-458-D [Read This]
